Terms and Conditions – Tire Pressure Pro

Please read these Terms and Conditions ("Terms") carefully before using the Tire Pressure Pro mobile application (the "App") operated by Tire Pressure Pro, a division of 6361099 Canada Inc, Sanders Motorsport and aSim operated by Marble Living Inc.

("us," "we," or "our").

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the App.

1. Acceptance of Terms

By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms apply to all users of the App, including browsers, customers, merchants, and contributors of content.

2. Purpose and Disclaimer

The App is designed to provide recommendations and data related to tire pressures for track day and racing applications. The data provided by the App is for informational purposes only and is based on theoretical models and user inputs.

YOU ACKNOWLEDGE AND AGREE THAT:

• You are solely responsible for the safety of your vehicle and      person.
• The App's recommendations are not a substitute for professional      advice or your own judgment.
• The App should not be relied upon as the sole source of information      for setting tire pressures.
• You must always adhere to the recommendations and safety guidelines      of your vehicle manufacturer, tire manufacturer, and track/racing      organization.
• We make no warranties or guarantees regarding the accuracy,      reliability, or completeness of the data and recommendations provided by      the App.

3. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL Tire Pressure Pro Div. of 6361099 Canada Inc, Sanders Motorsport, and aSim operated by Marble Living Inc. ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

1. Your access to or use of or inability to access or use the App.
2. Any conduct or content of any third party on the App.
3. Any content obtained from the App.
4. Unauthorized access, use, or alteration of your transmissions or      content.

4. Indemnification

You agree to defend, indemnify, and hold harmless Tire Pressure Pro, operated by 6361099 Canada Inc and aSim operated by Marble Living Inc., its licensees, licensors, employees, contractors, agents, officers, and directors, from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney’s fees) resulting from:

• Your use and access of the App.
• A breach of these Terms.

5. Intellectual Property

The App and its original content (excluding user-generated content), features, and functionality are and will remain the exclusive property of Tire Pressure Pro and its licensors, including 6361099 Canada Inc. The App is protected by copyright, trademark, and other laws of Canada and foreign countries.

6. User Responsibilities

You agree not to use the App for any unlawful or prohibited purpose. You are prohibited from:

• Attempting to decompile or reverse engineer any software contained      within the App.
• Removing any copyright or proprietary notations.
• Using the App in any way that could harm the App or its users.

7. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide at least 30 days’ notice before new terms take effect. Continued use after revisions constitutes acceptance.

8. Governing Law and Jurisdiction

These Terms shall be governed by the laws of Ontario, Canada, and North Carolina, USA. Any legal action shall be brought exclusively in those jurisdictions.

Disclaimer of Warranties; Limitation of Liability

1. Nature of the Service
       The Tire Monitor Pro app provides data and recommendations based on user      inputs and environmental conditions. Information is provided "as      is" and "as available."
2. User Responsibility
       You are solely responsible for safe operation of your vehicle.      Recommendations are not a substitute for professional advice or      manufacturer guidelines.
3. No Warranties
       We expressly disclaim all warranties, including implied warranties of      merchantability, fitness for a particular purpose, and non‑infringement.
4. Exclusion of Damages
       We shall not be liable for any damages, including loss of profits,      goodwill, data, or other intangible losses.
5. Vehicle and Personal Safety
       Track driving and racing are inherently dangerous. You assume all risks.      By using the App, you release Tire Pressure Pro Div. of 6361099 Canada      Inc, Sanders Motorsport and aSim operated by Marble Living Inc. from liability for injury, death, or property damage.

Legal Notice: Intellectual Property Protection

Tire Pressure Pro is proprietary software developed exclusively by Sanders Motorsport and 6361099 Canada Inc 

Unauthorized reproduction, distribution, reverse engineering, or imitation is strictly prohibited. Violations will result in:

• Cease and desist orders
• Civil lawsuits for damages
• Injunctive relief
• Attorney’s fees and court costs

Privacy Policy – Tire Pressure Pro

1. Information Collection

• User‑Provided Data (tire pressures, vehicle profiles, preferences)
• Device Information (OS, app version)
• User Agreements (records of acceptance)

2. Use of Information

• Provide and improve functionality
• Store data for reuse
• Maintain records of agreements

3. Data Retention

Data retained only as long as necessary or required by law. Deletion available upon request.

4. Data Sharing

Tire Pressure Pro, operated by 6361099 Canada Inc and aSim operated by Marble Living Inc., does not sell, rent, or trade personal information. Only anonymized/aggregated data may be shared.

5. Security

Industry‑standard measures implemented by 6361099 Canada Inc and aSim operated by Marble Living Inc. protect against unauthorized access or disclosure.

6. Your Rights

• Access/update personal data
• Request deletion
• Withdraw consent
